Voting and HVPOA

Original Bylaws of 1980 section 2.5: On all matters presented to a vote of the members, the holder of each membership shall nave one vote per lot.

Original Articles of Incorporation 1980 article 4: On all matters presented to a vote of the members, the holder of each membership shall have one (1) vote per lot.

New articles say "Class A shares shall have unlimited voting rights."

Utah Code:16-6a-206. The bylaws of a nonprofit corporation may contain any provision for managing the business and regulating the affairs of the nonprofit corporation that is not inconsistent with law or the articles of incorporation.

(in other words, if anything in your bylaws conflicts with anything in your Articles of Incorporation--you go by the Articles of Incorporation)

4.26.08 Protect your water rights!!!!
The original developers won't be protecting our water rights beginning this year. You MUST protect them yourself and keep them in force--it's complicated. Please go to the Utah water rights page and ensure that your papers are filed and your rights protected. You can go here for more information: UTAH WATER or call 801 578 8820 and talk to Brad Dobson about getting your water conveyed to your name--its very important! we will be having a workshop later this summer to let folks know what needs to be done.

Settlement Meeting Results

Thank you to everyone who attended and supported the Hideaway Valley settlement meeting! We applaud you all. There was an estimated 250+ attendees. What a turnout! The largest ever for Hideaway. We have been given a new beginning by all those that worked so hard for this to happen--on all sides. We have taken the first step into putting the 'unity' back into community because we all have worked hard to achieve this goal. Congratulations to us!

Terri Martin from the Utah Dispute Resolution chaired/mediated our settlement meeting. She skillfully kept the meeting on track while allowing members to voice their opinions. The association is extremely grateful to Ms Martin for her willingness to take us on and for the excellent way she ran our community meeting.

Attorney's Jim Blakesley and Alvin Lundgren presented the positions of the board and CPO in a straightforward manner and members were allowed to contribute in a discussion before each vote.

The votes carried as follows:

For a proposal to pass it needed 115 votes.
 
Results

(1) Corporate status: choice one passed 214/11/3 abstain
I want to form a subcommittee (or have an attorney) to review, rewrite and recommend new Articles of Incorporation which will then submit their recommendation to a vote of owners;  to  restate the Articles of Incorporation so they are identical to (original) 1980 Version with the 1990 Amendments and modifications to bring the Articles in compliance with current Utah law (without any substantive changes) or such changes along these guidelines as may be recommended by the subcommittee or attorney
 
(2) Number of trustees: choice one passed  159/67/2 abstain
          I want five (5) trustees on the Board
 
(3) Property Manager: choice one passed 197/28/3 abstain
            I do not want to retain the services of Carpenter and Associates
 
(4a) Annual Assessment: choice one passed 158/65/5 abstain
            I want the annual assessment of $350 for the 2007-08 fiscal year to
             remain
 
(4b) choice one passed 199/29
            I want the new board to establish a budget for fiscal year 2008, and to
            suggest an  annual assessment which shall be placed before a vote
            before enacting
 
(5) Attorney’s Fees for the CPO: choice one passed 148/77/2 abstain
            I authorize the newly elected Board to pay the reasonable attorneys
            fees  incurred by the Concerned Property Owners (CPO)
 
(6) Lot owner Membership Meetings: choice three passed 158
            I want to hold Association membership meetings quarterly
 
(7) ByLaws: choice one passed 200/21/4 abstain
            I want to form a subcommittee to (or have an attorney) review
            rewrite and recommend new Bylaws

Open Letter to the Utah dispute resolution Center

Dear Ms. McGahey,

Let me qualify myself before I share my comments. I am presently a senior member of the faculty of a college in Phoenix, Arizona.  I hold a BA and MA in Communication, and was a doctoral fellow in the Department of Communication at the University of Utah in the early 1970's. I finished my Ph.D. in Ed. Psych, also at U of U, in the early 1980s.  In addition, I am also a trained mediator.  (I completed the Northwest Mediation Center's basic and advanced mediation training for in-service professionals in 1992.)  I have 20 years experience in family and individual therapy and in teaching those skills, and beyond that, I have worked in both industry and in the public sector in training and in community psychological services.

I was a party to a community dispute that held its "settlement meeting" this weekend.  (I prefer the term "reconciliation" to "settlement" but the latter term is the one the judge used.)  That meeting was chaired (officiated?  conducted?) by Ms. Terri Martin of your office.

 I want to tell you what an outstanding job she did.  She was relatively informal, but fully professional.  She was friendly and concerned for the welfare of the whole community, but still independent, impartial and firm when necessary.  Her manner in dealing with members with conflicting views and agendas was quite a work of art.  I must say, on this latter point, that even with nearly 40 years experience in dealing with conflict situations, I doubt if I could have been as effective as she was.  This is a professional that I would be most proud to have on my own team...

While I told Ms. Martin in person that I thought she had done a good job, would you be so kind as to convey my compliments to her once again for a superb job of helping a damaged and wounded community reconcile and resolve its differences.

The County Land fill is FREE

If you can haul slash/construction material and old appliances in your pick-up, the land fill is free. It is located at mile post 269 between Mt. Pleasant and Ephraim on Hwy 89 on the west side of the street (small sign so you have to search). Please don't burn your slash for saftey reason. Haul it to the landfill or let us help you haul it.

I am hoping you can post something on the website about people speeding threw here! I was nearly in a head on wreck today just by the fork in the road before my house. The other car was going at least 50 MPH!!!! I had my lights on, and I had to honk to get her attention. Since the snow has melted and the asphalt is now visible it has become a huge concern on our BLIND corner and road in front of our house. I do not want one of our children or dogs hit. I am going to post a sign in our front yard, We live in a quiet recreational community, there is no need to be in such a hurry....Thanks
